2003-09-14 Why Do People Test Me? And the saga continues... My god, I never expected this whole quitting thing to be so fucking complicated, but it just keeps getting worse and worse. There have been new developments. I had to leave a message on my boss's home voice mail because he wasn't there, and I explained to him the story described in yesterday's entry. I heaved a sigh of relief, called my friend Andrea and chatted with her. Then there was a beep on the phone, indicating someone was calling on our other line. I went over, and lo and behold, it was my boss (or ex-boss, to be more accurate). Now, don't get me wrong: I know how shitty it must be to suddenly lose an employee with little or no warning and with no one to replace said employee. I'd be a little peeved too, but let's face it folks, it's not like I was there for all that long. Not only that, but I was still on my "week-long trial period", as I had never been formally offered the job. Anyway, he was upset. And he said that his "partner" - whoever the hell that is, I may never have met this person - will probably want to doc (sp?) me on my next pay check which I am to pick up next Friday. Uh, excuse me??? No, I don't fucking think so. I (politely) pointed out to him that nowhere on the contract does it say that I have to give any kind of notice. What it does explicitly say is that I am NOT considered to be an employee of that company - I'm an "independent contractor", ie, self-employed. Therefore, he is not allowed, legally-speaking, to doc me for any amount; I am to be paid for the hours that I worked, which amounts to 28 hours. And I am not a person who is likely to back down. In response to my reminder about the contract, he said that it's just common courtesy to give notice. I agree. But, sadly, common courtesy doesn't count for shit in the business world. If you want something to be done in a certain way, you put it in the goddamn contract. That's what contracts are for - they're for people who know that they shouldn't just assume that other people will be courteous and nice and will roll over and let you control them. And so, the contract is covering MY ass. I'm just not sure if he realizes all of this completely yet. I only mentioned the contract on the phone, but if necessary - if I don't have the full amount on Friday - I will make it very clear that he has to pay me the full amount. I will make it clear that I'm a stubborn bitch when I have to be, and I will not let it go. AND, I will drop a usually very effective name: the Norme du travail, which is basically a Better Business Bureau, watching out for the rights of employers and employees. No company wants the Norme on their back, but especially any that MIGHT be scamming people in any way, shape or form. And let me tell you - I will go to the Norme. It won't be an idle threat. I just hope it won't come to that, because they were (emphasis on past tense) nice to me while I worked there. It just seems like a bit of a shame. Gah! This totally sucks. What happened to the days when you could just quit a place and everyone moved on with their lives? It's spite that's driving them - they're mad that I quit, and now they're trying to get back at me. And I was only there for 7 days!! This is why you should never go work for a fucking 19-year-old. |
